Every product sold on Berton Well is an over-the-counter product. We do not sell, dispense, or fill prescription medications on this site. Product descriptions are drawn from the manufacturer's labeling. Nothing on this site is medical advice or a substitute for talking to a licensed healthcare professional.
You must be at least 18 years old and able to form a binding contract to place an order.
Your order is an offer to buy. We accept it when we ship the products to you. We may decline, cancel, or limit any order — including for suspected fraud, ordering errors, or quantities that appear to be for resale rather than personal use. If we cancel an order you've already paid for, we'll refund you in full.
Payments are processed through secure third-party checkout. We never see or store your full card number.
All sales are final on over-the-counter products, except for orders that arrive damaged, defective, or incorrect. Full details are in our Shipping & Returns policy, which forms part of these terms.
Use products only as directed on their labeling. Always read the Drug Facts label before use. Stop use and ask a doctor if you experience a reaction. Individual results vary, and we make no therapeutic claims beyond what appears on the approved product label.
To the fullest extent permitted by Florida law, Berton Clinical Corporation and its officers, directors, employees, and suppliers are not liable for any indirect, incidental, special, consequential, or punitive damages, or for any lost profits, lost data, or business interruption, arising out of or relating to your use of this site or any product purchased through it — even if we have been told such damages are possible.
Our total liability for any claim relating to an order is limited to the amount you paid for the product that the claim is about.
Nothing in these terms limits or excludes: (a) liability for death or personal injury caused by our negligence; (b) liability for fraud or fraudulent misrepresentation; or (c) any other liability that cannot lawfully be limited or excluded. Some states do not allow certain limitations, so parts of this section may not apply to you.
This section does not affect your rights under a product's own labeling, or under any applicable product-safety law.
If something goes wrong, please contact us at care@bertonwell.com or 1-888-5-BERTON before taking any formal step. Most problems are sorted out quickly and at no cost to you. We ask that you give us 30 days from the day we receive your written description of the problem to put it right, and we will do the same for you before we take any formal step.
These terms, and any dispute arising out of them or out of your order, are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules.
If we cannot resolve a dispute informally, it will be brought exclusively in the state or federal courts located in Broward County, Florida, and each of us consents to the personal jurisdiction of those courts. If you are a consumer living elsewhere in the United States, nothing here deprives you of the protection of any mandatory consumer-protection law of your home state.
Either of us may still bring an individual claim in small claims court if it qualifies.
These terms do not require arbitration. You are not giving up your right to go to court, and you are not giving up your right to participate in a class action.
We may update these terms. The version in effect when you place your order is the one that applies to that order. We'll update the "last updated" date above whenever we change anything.
