These terms apply to your use of bertonwell.com, including the Berton Well 55+ pages, and to every purchase you make on it. Please read them before you order. By using the site or placing an order, you agree to these terms.
Berton Well is operated by Berton Clinical Corporation, a Florida corporation. In these terms, “Berton Well,” “we,” “us,” and “our” mean Berton Clinical Corporation.
This address is for mail and approved returns only. We do not offer in-person pickup or visits.
Berton Well does not sell prescription products. Everything on this site can be bought without a prescription. Product descriptions are drawn from the manufacturer’s labeling.
You must be at least 18 years old and able to form a binding contract to place an order.
Your order is an offer to buy. We accept it when we ship the products to you. We may decline, cancel, or limit any order, including for suspected fraud, ordering errors, or quantities that appear to be for resale rather than personal use. If we cancel an order you have already paid for, we will refund you in full.
We charge your payment method when you place your order. If we cannot fill all or part of your order right away, we will ship the remaining items as soon as they are available, or refund you for any item we did not ship.
All prices are in U.S. dollars. Promotional discounts may apply at checkout. Prices and product availability can change at any time before you place an order. If a product is listed at an incorrect price, we may cancel the order and refund you rather than honor the error; we will always tell you first. Sales tax is charged where required by law.
Promotional codes are limited to one per order unless the code says otherwise. They have no cash value, cannot be applied to past orders, and may expire or be withdrawn at any time. Discounts apply to the product subtotal, not to shipping or tax.
Payments are processed through secure third-party checkout. We never see or store your full card number.
Shipping options, delivery times, and our returns rules are set out in our Shipping & Returns policy, which forms part of these terms. All sales are final, except for orders that arrive damaged, defective, or incorrect.
Ownership of the products, and the risk of their loss or damage, pass to you when we hand your order to USPS, UPS, or FedEx. For same-day orders, they pass to you when our courier records the delivery.
We may ship an order in more than one package, for example when an item is on backorder. We do not charge extra shipping for splitting an order.
Products are sold for your personal or household use. You may not resell them or list them on any other website or marketplace. We may limit quantities or cancel orders that appear to be for resale.
By providing your mobile number at checkout, you agree that Berton Well may send you text messages about your order, such as order confirmations, shipping and delivery updates, and questions about your delivery. These messages are about your order only. We will not send you marketing texts unless you separately agree to receive them.
Message frequency varies by order. Message and data rates may apply. Reply STOP to stop receiving texts, or HELP for help. Mobile carriers are not liable for delayed or undelivered messages. If you opt out of texts, we may contact you about your order by email or phone call instead.
You also agree that we may contact you about your order by email, and that an email from us counts as written notice.
Use products only as directed on their labeling. Stop use and ask a doctor if you experience a reaction. Individual results vary, and we make no claims about any product beyond what appears in the manufacturer’s labeling.
Berton Well is a retailer, not the manufacturer. Any warranty on a product is provided by its manufacturer, not by Berton Well. To the fullest extent permitted by law, we sell products without any warranty of our own, express or implied, including any implied warranty of merchantability or fitness for a particular purpose. Some states do not allow implied warranties to be excluded, so this may not apply to you.
This does not affect our commitment to replace or refund orders that arrive damaged, defective, or incorrect, as described in our Shipping & Returns policy.
To the fullest extent permitted by Florida law, Berton Well and its officers, directors, employees, and suppliers are not liable for any indirect, incidental, special, consequential, or punitive damages, or for any lost profits, lost data, or business interruption, arising out of or relating to your use of this site or any product purchased through it, even if we have been told such damages are possible.
Our total liability for any claim relating to an order is limited to the amount you paid for the product involved in that claim.
Some liability cannot be limited by law. This section does not limit our liability for death or personal injury caused by our negligence, for fraud, or for anything else the law does not allow us to limit. Some states do not allow certain limitations, so parts of this section may not apply to you.
This section does not affect your rights under a product’s own labeling, or under any applicable product-safety law.
If something goes wrong, please contact us at orders@bertonwell.com or 1-888-5-BERTON before taking any formal step. Most problems are resolved quickly and at no cost to you. We ask that you give us 30 days from the day we receive your written description of the problem to put it right, and we will do the same for you before we take any formal step.
These terms, and any dispute arising out of them or out of your order, are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules.
If we cannot resolve a dispute informally, it will be brought exclusively in the state or federal courts located in Broward County, Florida, and each of us consents to the personal jurisdiction of those courts. If you are a consumer living elsewhere in the United States, nothing here deprives you of the protection of any mandatory consumer-protection law of your home state.
Either of us may still bring an individual claim in small claims court if it qualifies.
These terms do not require arbitration. You are not giving up your right to go to court, and you are not giving up your right to participate in a class action.
The text, images, logos, and other content on this site belong to Berton Well or its licensors and are protected by law. You may view and print pages for your own personal use. You may not copy, reproduce, or use them for any commercial purpose without our written permission. Product names and trademarks belong to their respective owners.
Please do not misuse the site. This includes trying to gain unauthorized access, interfering with how it works, collecting its content by automated means, or placing orders with someone else’s payment details.
How we collect and use your information is explained in our Privacy Policy, which forms part of these terms.
These terms, together with our Shipping & Returns policy and Privacy Policy, are the entire agreement between you and Berton Well about your use of this site and your purchases.
If any part of these terms is found to be invalid or unenforceable, the rest of the terms remain in effect.
If we do not enforce a part of these terms right away, we have not given up our right to enforce it later.
These terms are between you and Berton Well. You may not transfer them, or any rights under them, to anyone else. We may transfer them to another company, for example if our business is sold or reorganized.
We are not responsible for delays or failures caused by events beyond our reasonable control, such as severe weather, natural disasters, carrier disruptions, power or internet outages, supply shortages, or government action. If this affects your order, we will let you know, and if we cannot fill it, we will refund you.
We may update these terms. The version in effect when you place your order is the one that applies to that order. We will update the “last updated” date above whenever we change anything.
